You acknowledge that certain parts of the Platform, are provided by third-party service providers, and you agree to abide by their terms and conditions. ZigyaAI shall not be responsible for any disruption of services caused by such third-party service providers. 1- Introduction

  • These Terms will be applied fully and affect to your use of this Website. By using this Website, you agreed to accept all terms and conditions written in here. You must not use this Website if you disagree with any of these Website Standard Terms and Conditions.
  • Minors or people below 18 years old are not allowed to use this Website.

2 - Intellectual Property Rights

  • Other than the content you own, under these Terms, Jigserv Digital Private Limited and/or its licensors own all the intellectual property rights and materials contained in this Website.
  • You are granted limited license only for purposes of viewing the material contained on this Website.
  • As a condition of accessing the Platforms and/or using the courses, you agree not to (a) reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose any content or any portion of it thereof, other than as expressly allowed under these Terms; and (b) use the ZigyaAI or Jigserv name, trademarks, service marks, or other materials of any Course Creator in connection with, or to transmit, any unsolicited communications or emails or for any other unauthorised purpose.
  • Please verify all content prior to use. In the event you come across any content that is incorrect, infringing, offensive, indecent or objectionable, please notify us immediately at the address mentioned at the bottom of this page.
  • ZigyaAI respects third-party intellectual property rights and actively supports protection of all third-party intellectual property including copyrights and trademarks (“IP”). It is our policy to expeditiously respond to clear notices of alleged IP infringement. If we receive proper notification of IP infringement, our response to such notices will include removing or disabling access to material claimed to be the subject of infringing activity.
  • ZigyaAI shall not be held liable for the unauthorised use of any third-party IP, and the user that carries out such unauthorised use or infringes any IP available on the Platform shall fully indemnify and hold ZigyaAI / Jigserv and its employees harmless against any and all claims that may arise as a result of such use.
  • If you believe that your product or other work has been misrepresented or used in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide us with the following information:
    • an electronic or physical signature of the person authorised to act on behalf of the owner of the product, copyright or other intellectual property interest;
    • a description of the product, work or other intellectual property that you claim has been misrepresented or infringed;
    • a description of where the material that you claim is misrepresenting or infringing your product, work or other intellectual property is located on the Platform/Course;
    • your address, telephone number, and email address;
    • a statement by you that you have a good faith belief that the disputed use is not authorised by the owner of the product, work, copyright or intellectual property, or its agent, or applicable law; and
    • a statement by you, made under the penalty of perjury, that the aforementioned information in your notice is accurate and that you are the product, work, copyright or intellectual property owner or authorised to act on such owner's behalf.

3 - Restrictions

  • You are specifically restricted from all of the following:-

4 - Your Content

  • In these Website Standard Terms and Conditions, "Your Content" shall mean any audio, video text, images or other material you choose to display on this Website. By displaying Your Content, you grant ZigyaAI a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.
  • Without limitation, you will not post or transmit, or cause to be posted or transmitted, any communication or solicitation or other "phishing", "pharming" or "whaling" message designed or intended to obtain password, account, personal information, confidential information or private information from any user of the Platform or any other third party whatsoever. However, if any such event does take place, ZigyaAI shall not be liable for any loss of data or if the user’s device, computer system or any other property is compromised in any manner.
  • In your registration process, you may be prompted or required to enter additional information, including but not limited to your name and email address. Additional information may be required to confirm your identity. You understand and agree that all information provided by you is accurate, current and complete and that you will maintain and update your information to keep it accurate, current and complete. You acknowledge that if any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your use of the Platform and your enrolment into a course to the extent applicable.
  • Your Content must be your own and must not be invading any third-party’s rights. ZigyaAI Pro Learning reserves the right to remove any of Your Content from this Website at any time without notice.
  • You acknowledge and agree that ZigyaAI has the right to report any and all such suspicious or illegal activity to the appropriate legal or police authorities without notice to you.

5 - Courses, Creators and Educators

  • ZigyaAI is NOT a university, but a service provider, enabling Courses of Indian and International universities, educational institutions, governmental authorities, NGOs, Corporates, Individuals etc. (each a “Course Creator” or “Educator”).
  • Each course may have a separate set of terms dealing with refunds, deferrals, payments, rewards etc. governing such courses, and our corporate clients may have executed separate written agreements with us, which, in the event of a conflict, will supersede these Terms to the extent of the conflicting provisions.
  • Admission to the degree/diploma programs of a Course Creator is separate from being accepted into and/or taking one or more Courses. You agree and acknowledge that nothing in these Terms or otherwise with respect to the use of the Platform or any Course (a) enrolls or registers you in a Course Creator, or any other school, division, institute or program of or associated with a Course Creator, and (b) allows you to access or use the resources or receive any benefits or privileges of a Course Creator, beyond the Courses.
  • You will not receive academic credit from ZigyaAI for taking a Course. If you are taking a Course for academic credit or certification as a student of, or otherwise through, a Course Creator, any such credit or certification may only be awarded directly by the Course Creator based on its own policies and procedures, and you may be required by that Course Creator to be registered or enrolled with the Course Creator in order to receive credit or certification; and, in any event, ZigyaAI will not have any authority or responsibility with respect to any award of academic credit or certification provided by an Course Creator for a Course.
  • You acknowledge and agree that any Course affiliated with a Course Creator may be subject to the terms, policies and procedures of the applicable Course Creator in addition to ZigyaAI Pro Learning’s Terms. Without limiting the foregoing, if you are a student registered or enrolled at, or are otherwise attending a Course for credit or certification through that Course Creator, you acknowledge and agree that (a) the Course Creator may have its own terms, policies or procedures regarding your eligibility to participate in the Course, your participation in the Course, the requirements or prerequisites for receiving credit or certification for the Course, and/or your educational or student records as they may relate to your participation and performance in the Course, and (b) your educational or student records are maintained by the Course Creator, including for purposes of assigning credit or certification, and not ZigyaAI.

6 - Force Majeure

  • You agree that ZigyaAI / Jigserv shall be under no liability whatsoever to you in the event of non-availability of the Platform or any portion thereof occasioned by Act of God, war, disease, revolution, epidemic, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of any public utility, man-made disaster or any other cause whatsoever beyond the control of ZigyaAI / Jigserv.

8 - No warranties

  • This Website is provided "as is," with all faults, and ZigyaAI / Jigserv Digital Private Limited express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.
  • ZigyaAI makes no representations that the Platform operates (or is legally permitted to operate) in all geographic areas, or that the Platform, or information, services or products offered through the Platform are appropriate or available for use in other locations. Accessing the Platform from territories where the Platform, or any content or functionality of the Platform or its portions thereof is illegal, is expressly prohibited. If you choose to access the Platform, you agree and acknowledge that you do so on your own initiative and at your own risk and that you are solely responsible for compliance with all applicable laws.

9 - Limitation of liability

  • In no event shall ZigyaAI / Jigserv Digital Private Limited, nor any of its officers, directors, affiliates, and employees, shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. Jigserv Digital Private Limited, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

10 - Indemnification

  • You hereby indemnify to the fullest extent ZigyaAI / Jigserv Digital Private Limited from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

11 - Severability

  • If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

12 - Variation of Terms

  • ZigyaAI / Jigserv Digital Private Limited is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

13 - Assignment

  • ZigyaAI / Jigserv Digital Private Limited is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

14 - Entire Agreement

  • These Terms constitute the entire agreement between ZigyaAI / Jigserv Digital Private Limited and you in relation to your use of this Website, and supersede all prior agreements and understandings.

15 - Governing Law & Jurisdiction

  • These Terms will be governed by and interpreted in accordance with the laws of the State of India in Maharashtra, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Maharashtra for the resolution of any disputes.

Referral Policy

ZigyaAI enables higher education and industry-relevant diploma, certification programs (“Program”,“Course”, “Courses”) some of which qualify under the Referral Program.

This Referral Policy applies to users (referred to as “referrer”, “referee”, “user”, “users'') who are participating in Referral Program (the “Scheme”) of ZigyaAI (“ZigyaAI”). User participation in the Scheme is deemed if (a) user downloads a Referral Code (b) user shares his Referral Code with others by any means whatsoever, or (c) user uses another’s referral code for downloading Brochure / application on ZigyaAI Platform.

By participating in this Scheme, you acknowledge and agree to be bound by all of the terms and conditions of this referral policy (“Policy”), which are in addition to and subject to ZigyaAI Pro Learning Platform’s “Terms and Conditions” and “Privacy Policy'' available on the Platform. By accepting this Referral Policy, you consent, agree and undertake to abide, be bound to the terms of this Referral Policy. If you do not agree to this Policy, please do not participate in the Scheme. Jigserv / ZigyaAI reserves the right to modify or terminate the Scheme, in whole or in part, at any time and in any manner.

1. Definitions:

“Course” means the courses which qualify under the Referral Policy as mentioned on ZigyaAI course/program from time to time.
“Referrer” means either an individual who is interested in enrolling for a program and is willing to invite his friend for same program or any other program which qualifies under the Jigserv Referral Policy.
“Referee” means the individual being referred by a Referrer.
“Referral Code” is the code generated when the Referrer submits his own application or otherwise in a manner decided by ZigyaAI.
“Reward” means the benefit receivable under this policy, in the form of cash, vouchers or fee waivers, as the case may be.

2. Criteria

  • Both Referrer and Referee should enrol and participate in any program qualifying under Referral Policy of ZigyaAI
  • Referee and Referrer shall be eligible for any Referral benefit, only if the Referral code of Referrer is used by the Referee at the time of sign-up for a Course qualifying under Referral Policy of ZigyaAI
  • Referral code has to be used by both Referrer and Referee within its validity period
  • Scheme is valid only for Residents and Citizens of India
  • Decision of ZigyaAI with respect to the eligility and value of Referral Reward will be final

3. Process

  • The Referrer must generate a Referral Code on the Referral page of the Platform.
  • Referrer should share her/his Referral Code with a Friend, which in turn must be used/applied by the Friend while downloading brochure through ZigyaAI
  • Referrer and Referee should enrol for any of the Courses qualifying under the Referral Policy of ZigyaAI
  • Both Referrer and Referee must pay the entire fee amount before the expiry of the Referral Code for the Referral to be considered completed.
  • ZigyaAI / Jigserv does not take any responsibility for selection and acceptability of Referrer or Referee by the Institute for any Course

4. Qualifying Courses and Value of Referral Reward

  • As mentioned in ZigyaAI Referral Rewards page .

5. Claim & Disbursement of Reward

  • Unless specified otherwise, both Referrer and Referee will receive a Cashback / Gift Voucher as per referral program, subject to TDS, within thirty (30) working days from the commencement date of the Course of the Referee.
  • The Enrolled Referrer and Referee must fill and submit the referral claim form giving the bank account details to receive the cashback payout.
  • Any payment will be done net of TDS as per prevailing Regulations. User needs to provide the relevant declarations and information for determination of the same.
  • Referrer or Referee should not be a Specified Person as per IT Act "specified person" means a person who has not filed the returns of income for both of the two assessment years relevant to the two previous years immediately prior to the previous year in which tax is required to be deducted, for which the time limit of filing return of income under sub-section (1) of section 139 has expired; and the aggregate of tax deducted at source and tax collected at source in his case is rupees fifty thousand or more in each of these two previous years

6. Fair Usage Requirements

  • The referrer must refrain from sharing his or her code with any employee at ZigyaAI Pro Learning / Jigserv or entity associated in the direct sale of any of ZigyaAI’s Courses for the purpose of getting the code used by ZigyaAI’s prospective learners who the referrer has no connection with.
  • The Referral Code usage shall be evaluated on a case-to-case basis by ZigyaAI and ZigyaAI holds the power to block the Referral Code if any misuse is suspected, at the sole discretion of ZigyaAI. Decision of ZigyaAI will be final in this case.
  • The Referral Code once entered by the user for a Course, cannot be modified/changed.
